Abstract
Land redistribution in Dharmasraya Regency, West Sumatra is one of the Agrarian Reform activities. Land for Agrarian Reform Objects (TORA) in this area is obtained from customary land by first converting it to state land. The ulayat land in question is the area of inheritance land along with the natural resources that exist above and therein which are obtained from generation to generation, and are the rights of the customary law community in the Province of West Sumatra. This is in accordance with Article 1 Paragraph (7) of the Regional Regulation of West Sumatra Province Number 16 of 2008 concerning Communal Land and Its Utilization. This study examines why communal land was chosen as TORA; and the process of determining the customary land into state land. This study uses a qualitative method coupled with a spatial approach (spatial approach). The results of the study show that the determination of ulayat land to become state land is a shortcut for the Ministry of ATR/BPN in obtaining TORA. On the other hand, respect for customary law communities in determining the TORA is carried out by involving the Nagari Adat Density (KAN) institution in Nagari Timpeh, Dharmasraya Regency.
