Abstract
Land disputes with overlapping typologies of ownership of land rights are dispute complaints that are often reported to the Land Office. The overlapping ownership of land rights occurs due to the existence of multiple certificates where one plot of land is described with 2 or more certificates with different data, both subject and object. Therefore we need a settlement of land cases. The existence of weaknesses in the settlement of land cases through litigation has made people begin to turn to alternative dispute resolution, namely mediation at the Land Office. This research is a legal research with an empirical method through a case approach. This study aims to find out the problems and strategies for resolving cases of overlapping land rights ownership through mediation and to find out the transition process for the application of new regulations, namely the Regulation of the Minister of Agrarian Affairs with Spatial Planning/Head of the National Land Agency of the Republic of Indonesia (Permen ATR/Ka. BPN). Number 21 of 2020 concerning Handling and Settlement of Land Cases at the Mempawah Regency Land Office. Keyword: Dispute, Mediation, Regulation
