Abstract

Certificates as proof of rights to the resulting land can be canceled if there is an administrative defect in its issuance. One of the cases is the problem of Salve Veritate company with Harto Khusumo. The Head of the Regional Office of the National Land Agency of DKI Jakarta Province issued Decree No. 13 / Pbt / BPN.31 / IX / 2019 dated 30/09/2019 concerning the cancellation of 38 Certificates of Building Use Rights of Salve Veritate company. The Decree of the Head of the regional office was then canceled by the Decree of the Minister of Agrarian affairs and Spatial Planning/Head of the National Land Agency No. 3/pbt/KEMATR/ BPN/V/2021 dated 31/05/2021 concerning the Cancellation of the Decree of the Head of the regional office No. 13/Pbt/BPN.31/IX/2019 dated 30/09/2019. This study aims to analyze the problems and the process of issuing the two Decrees. Research using normative-empirical legal methods. Data are obtained through interviews directly with predetermined informants. In addition to conducting interviews, researchers also conduct document studies of court decisions and laws and regulations. The results showed that the Head of the regional office of the National Land Agency of DKI Jakarta Province did not make a Minutes of Field Examination and Dispute Resolution Report as stipulated in the Regulation of the Minister of Agrarian affairs and Spatial Planning / Head of the National Land Agency Number 11 of 2016 concerning Settlement of Land Cases. In its issuance, the Decree of the Head of the Regional Office of the National Land Agency of DKI Jakarta Province No. 13 / Pbt / BPN.31 / IX / 2019 dated 30/09/2019 concerning the cancellation of 38 Certificates of Building Use Rights of Salve Veritate company contains procedural defects and/or juridical defects as well as procedural and/or substance defects in its issuance.
