Abstract
The Land Use Change Permit policy after the implementation of the Omnibus Law and the issuance of Government Regulation Number 21 of 2021 underwent changes in governance. The permits previously contained in Article 163 Paragraph (1) of Government Regulation Number 15 of 2010 have been integrated into the Suitability of Spatial Utilization Activities (Kesesuaian Kegiatan Pemanfaatan Ruang). However, the Land Technical Consideration mechanism is still used as a process that supports the acquisition of KKPR. The existence of Land Technical Considerations which is used as legality for the community to make changes to land use in Indragiri Hulu Regency, Riau Province until the end of 2021 is something that happens in reality in an area that actually contradicts the applicable legal provisions. Through this paper, the author wants to describe the implementation of Land Technical Considerations in the issuance of the Land Use Change Permit which has now been replaced by the KKPR mechanism through the Online Single Submission - KKPR system, explain the role of Land Technical Considerations in licensing in Indragiri Hulu, and explain the ideal legal solution. on the issuance of Persetujuan KKPR in Indragiri Hulu Regency. This study uses a qualitative method with a descriptive approach. Search data to support this paper is done through observation, interviews and document searches. The results showed that the implementation of the Online Single Submission - KKPR in Indragiri Hulu did not run effectively. The absence of a Regency Spatial Plan has made Land Technical Considerations organized by the Land Office the main requirement in obtaining space utilization permits. Legal solutions to the issuance of Persetujuan KKPR in Indragiri Hulu will be implemented in accordance with statutory provisions.
