Abstract

Recommendation for Land Rights on Management Rights is a letter issued by the Batam Free Trade Zone and Free Port Authority (BP Batam) as the holder of the Management Rights to the Batam City Land Office recommending an increase in the status of Land Rights of land users of Ready to Build Lots (KSB) that have met the requirements. In 2022, a Complete Systematic Land Registration (PTSL) program was implemented in one of the KSBs where the land parcels that became the object of PTSL still had the name of PT SBI and did not have a Lot Letter which should have been issued by BP Batam. Therefore, Land Rights Certificates in the form of Building Rights Certificates on Management Rights cannot be issued to people living in the area under the name of PT. SBI because they do not have a Plot Letter which is one of the requirements for the issuance of Land Rights Recommendations on Management Rights. The objectives of this study are to determine the factors that prevent the issuance of Land Use Rights Certificates in the area under the name of PT SBI, the effect of the Lot Letter issued by PT SBI on the registration status of community rights, and alternative solutions that can be provided to resolve the legality issues of community lots living in the area under the name of PT SBI. The research method used is descriptive research method with quantitative approach to support the data obtained through the target number of Land Rights Certificate issuance set by the Batam City Land Office in Sungai Pelunggut Urban Village and through questionnaires with Likert Scale as a form of public perspective on the validity of the right base and public participation in managing the legality of lots in the issuance of Land Rights Recommendation on Management Rights. The data in this study were obtained through interviews and surveys in the area under the name of PT SBI. The results and analysis of this study are: First, there is no simultaneous and significant influence between the variable of the validity of the right base and the variable of community participation in managing the legality of the lot on the issuance of Land Rights Recommendations on Management Rights. Because the community needs to participate first to take care of the validity of the title to PT SBI and after that the title can be used to apply for the issuance of Recommendations for Land Rights on Management Rights. Second, the title deed in the form of Plot Letter registered in the database of BP Batam is very influential in the issuance of Land Rights Recommendation and Land Rights Certificate. Third, an alternative solution that can be offered is to collectively manage the legality of the lots to PT SBI, then forward it to BP Batam to issue an invoice for the Annual Mandatory Money along with the Land Rights Recommendation to be paid by the community so that the Land Rights Certificate can be issued.
