Abstract

Land is an important aspect of life, so many disputes are caused by land. One example that occurred in the Prigi Nusantara Fishing Port Area. This study aims to determine the chronology and factors causing overlapping control and/or ownership of land in the Prigi Nusantara Fishing Port Area, as well as knowing the solution based on existing laws and regulations. The research method used is normativeempirical juridical. The results showed that the chronological history of land tenure and/or ownership in the Prigi Nusantara Fishing Port Area by the Ministry of Maritime Affairs and Fisheries is divided into 3 stages, namely exchange, Regional Property Grants, and Land Acquisition and Application for Land Rights. While the history of land control and / or ownership by PT Perikanan Indonesia is derived from the Initial Capital Determination of Perum Prasarana Perikanan Samudera. There are 4 factors causing overlapping land tenure and/or ownership in the Prigi Perikanan Nusantara Port Area. According to the legislation, there are 2 paths to resolve land issues, namely non-litigation and litigation. Recommendations in resolving overlapping land tenure and/or ownership in the Prigi Nusantara Fishing Port Area, namely carrying out inventory, identification and validation of land assets and / or buildings on it by paying attention to spatial and juridical aspects. The first form of settlement when taking the non-litigation route is to cooperate in the utilization of State Property. The second form is to apply the type of Land Rights in Hak Guna Bangunan above Hak Pengelolaam when taking the win-win solution path.
