Abstract

The characteristics of land regulation and management in Batam City are different compared to other regions in Indonesia. The implementation of PTSL in Batam City is carried out in three locations, namely on state land, on BP Batam Management Right land and in the Old Village area. The implementation of PTSL in the Old Village Area and on Management Right Land requires recommendations. However, from the submission of recommendation issuance which was carried out collectively through the Batam City Land Office, not all files could be published. The purpose of this study is to determine the legal construction of granting land rights, issuance procedures and factors that influence the issuance of recommendations. The method used in this research is descriptive qualitative where the qualitative data is processed and presented in the form of a description. Based on the research results, the granting of land rights over land with Management Rights and in the Old Village area requires a recommendation in the form of a Certificate Recipient Candidate Decree and a Recommendation. There are factors that influence the smooth issuance of recommendations for granting land rights, which consist of external factors and internal factors.
