Abstract

Cluster 3 is a cluster where land parcels have previously been measured but certificates cannot be issued because of problematic or incomplete juridical data and community resistance. Problems in the implementation of PTSL in Batam City are fairly complex, because Batam City is in the area of Management Rights (HPL) managed by the Batam Concession Agency (BP Batam). Therefore, the problem formulated in this research includes how the typology of PTSL Cluster 3, the cause of the occurrence of Cluster 3 in PTSL, and how the solution is applied in order to reduce the Cluster 3. The purpose of this research is to find out the problems that occur in the implementation of PTSL especially in the HPL area. The method used in this research is qualitative with descriptive approach for data collection through interview, documentation, and observation techniques. There are three locations used as the object of data collection, namely Batam City Land Office, BP Batam, and Sungai Pelunggut Village. Data collection through interviews using purposive sampling method with the number of informants 8 people which include the head of the office, head of adjudication, deputy head of juridical, juridical data collection officer, physical data collection officer, land acquisition section at BP Batam office, village head, and community in Sungai Pelunggut Village. The number of Cluster 3 in Batam City is 7,427 land parcels, this number is the total number of Cluster 3 from 2020 to 2022. Meanwhile, there are two typologies of Cluster 3 in Batam City, namely Cluster 3.1 and Cluster 3.3. The results of research conducted in Sungai Pelunggut Urban Village to find out the causes of Cluster 3 in Batam City, especially in the HPL area, are due to people who are not domiciled in the location of PTSL determination, lack of coordination between the Land Office and BP Batam, and the process of issuing recommendations is not timed so that SHAT in the year of PTSL implementation ends. There are efforts made by the Land Office and BP Batam such as the application of Tagging and 50% discount for UWTO payment. Keywords: PTSL, Cluster 3, HPL
