Abstract

Land acquisition is a necessity to support the realization of public facilities and if the government does not have land for development, it will carry out land acquisition from land owned by the community both individually and institutionally. Basically, land acquisition is an activity to provide land for those who need land by providing adequate and fair compensation. The Demak District Land Office and third parties (appraisal) experience obstacles in determining the amount of compensation for land parcels in coastal areas, because the surface of the land parcels is already covered by rising sea water or tidal floods. This study aims to determine the feasibility and mechanism for calculating the amount of compensation for land loss as a form of handling social impacts on land acquisition for the Semarang-Demak Toll Road based on legal aspects seen from Presidential Regulation No. 52 of 2022 and economic aspects based on market value with an income capitalization approach. This research uses quantitative descriptive research method. The findings of the research conducted that the comparison between the determination of the amount of the value of kerohiman fund assistance using calculations based on Presidential Regulation No. 52 of 2022 with the results of calculations based on market value using the income capitalization approach there is a large gap in value. The existence of a large enough value gap makes it possible for policy makers in the future to reconsider the amount of compensation assistance so that it becomes a step towards the realization of justice, welfare and prosperity in providing compensation assistance for land destruction.
