Abstract

The execution of auction requires the limit value to be set with the highest range equal to the market value and the lowest equal to the liquidation value. However, in reality, there is still inconsistency in determining the limit value, liquidation value, and market value in the auction process. This results in the principle of justice not being achieved for both parties involved in the auction. The purpose of this study is to determine the consistency in the implementation of determining market value, liquidation value, and limit value that are fair in auctions according to the provisions of Minister of Finance Regulation Number 122 of 2023, identify the issues that arise in the implementation of determining market value, liquidation value, and limit value that are fair in auctions for a residential property in Purbalingga Regency, and identify proposed solutions to resolve the issues that arise. This research was conducted using a case study approach and applying a comparative descriptive method in qualitative approach. The results of this study found that in the auction process of a residential property in Wirasana Village, Purbalingga Sub-District, Purbalingga Regency, it is not consistent. The limit value is set equal to the liquidation value, which can disadvantage the debtor. This reflects the lack of procedural justice and justice for the debtor. Legal actions that can be taken by the debtor who feels disadvantaged in this case are to file a civil lawsuit with the District Court.
