Abstract

The form of conflict in this research is related to land control over HGB No. 15 Nglames Subdistrict. The aim of this research is to determine the chronology of the land conflict that occurred between the Rejo Agung Baru Sugar Factory and the people of Nglames Village. To find out the factors that cause land conflicts. To find out how to resolve conflicts. To answer the problem formulation, the research method used is an empirical legal research method with a legal sociology approach. The results of the research show that, since the 1970s, the community has occupied HGB No. 15 who was originally only an employee/worker at the Rejo Agung Baru Sugar Factory but as time went by the Rejo Agung Baru Sugar Factory no longer managed and utilized assets since the expiration of the HGB certificate No. 15 has resulted in more and more people occupying HGB No. 15 to reach 80 families. The conflict began to arise when the Rejo Agung Baru Sugar Factory again took care of granting new rights to HGB No. 15 which then experienced rejection from the community in terms of signing a statement stating that the land the community was occupying at that time was an asset belonging to the Rejo Agung Baru Sugar Factory. This statement letter is one of the requirements that the Madiun Regency Land Office requires before carrying out the process of extending, renewing or granting new rights. The factors that cause land conflicts are divided into 2 (two) categories, namely factors according to the Rejo Agung Baru Sugar Factory and factors according to the people of Nglames Village. The causal factors according to the Rejo Agung Baru Sugar Factory consist of: The Rejo Agung Baru Sugar Factory does not know the rights and obligations as a rights holder, lack of orderly administration of asset management in the past, and lack of competent human resources. Meanwhile, the factors causing conflict according to the people of Nglames Subdistrict consist of: the people do not understand the status of the land they have been living on, the people do not know the historical origins of their land and the majority of the community's economy is lower middle class. There are several conflict resolution efforts, namely: consultation, negotiation and mediation. However, from the several resolution efforts that have been made, an agreement has not been found between the two parties in the conflict until the writing was done.
