Abstract

Indonesia is located between three active plates which make Indonesia prone to natural disasters. Bantul Regency is proof that there are various potential natural disasters, one of which is landslides. Landslide-prone points are spread across several parts of the hilly Bantul Regency area. Based on a technical study of landslides carried out by the Bantul Regency Government in 2010 and 2012, there were 2,543 houses in the red zone prone to landslides. As a preventive measure, the Regional Government of Bantul Regency has designed a relocation program for people living in red zones prone to landslides. The use of village treasury land for relocation was chosen as an answer to the limited availability of relocation land. However, DIY's specialty has been recognized nationally and has an impact on the land sector. The enactment of the UUK was also the basis for the birth of new regulations related to village treasury land. This research was conducted qualitatively with an empirical juridical approach to know the process of utilizing village treasury land for the relocation of communities in landslide-prone areas in Bantul Regency, accordance with applicable regulations and the impacts caused. The process of utilizing village treasury land for the relocation of communities in landslide-prone areas of Bantul Regency uses moorland whose development is carried out by the community. In the process of using village treasury land for relocation, there are still inconsistencies with applicable regulations in the form of administrative disorder which results in the absence of legal certainty over the land in the relocation area given to the community.
