Abstract

Violations of spatial utilization in the riverbank area are often found in various regions, for example, in the Cibeet Riverbank area, where a waterpark recreational area was built in the middle of 2019. The development of the recreational area was located within the Riverbank Area and Agricultural Land for Food Crops designated by Bekasi Regional Regulation No. 12 of 2011 regarding the Bekasi Regional Spatial Plan 2011-2031. The building located on the riverbank also violated the provisions of Ministry of Public Works and Housing Regulation No. 28/PRT/M/2015 of 2015 regarding the Determination of Riverbank Boundary and Lake Boundary. Article 6 states that the Cibeet River is considered a large river that does not have a dam outside the city area. As a large river with a drainage area of more than 500 km2, the boundary is determined to be at least 100 meters from the left and right banks of the river along the river channel. The purpose of this research is to identify the problems and solutions for spatial utilization control through criteria and administrative sanction procedures imposed on the waterpark owner based on Government Regulation No. 15 of 2010 regarding Spatial Planning Management. This research uses a qualitative descriptive research method with data collection techniques such as interviews, observations, and documents. Based on this research, it can be concluded that the type of administrative sanction imposed on the waterpark owner is demolition of the building with the aim of restoring spatial function.
