Abstract

The stipulation of the Special Law (UUK) gives special authority to the Special Region of Yogyakarta in managing its region, one of which is in the land sector. One of the authorities included in this field is the regulation of village land in DIY. Based on DIY Special Region Regulation no. 1 of 2017, which is a derivative regulation of UUK, village land is claimed to be the property of the Sultanate/Duchy based on the originary rights of the anggaduh rights. In fact, if you refer to the regulations in the UUPA and Village Law, village land is a village asset that is given use rights in the name of the village government as a source of village wealth. This research aims to examine the synchronization of national land law with the implementation of UUK, along with its implementation and impact in Sleman Regency. The method used is normative-empirical juridical, by examining various regulations relating to village land and the ontological basis for their stipulation, as well as identifying the implementation and impact of the stipulation of these regulations. From this research, it was revealed that there are 3 (three) aspects of synchronizing village land regulations with national land law, namely the subject of rights, the status of rights and the process of legalizing village land. Implementation of village land legalization in Sleman Regency is in accordance with ATR/BPN Ministerial Regulation No. 2 of 2022 concerning Registration of Sultanate Land and Duchy Land in the Special Region of Yogyakarta. The determination of village land as the property of the Sultanate/Duchy has a legal and economic impact on the village government, because authority over village land is dominated by the Sultanate/Duchy as the owner of the rights.
