Abstract

Land ownership rights are a crucial legal concept that grants authority, responsibility, and limitations to landowners in managing and utilizing their land. Land certificates issued by governmental bodies such as the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency ensure legal certainty concerning the status, object, and subject of land ownership, thereby facilitating property transactions on clear legal grounds. In Indonesia, the Comprehensive Systematic Land Registration (PTSL) program aims to expedite nationwide land certification by 2025, as directed by President Joko Widodo. However, PTSL implementation in Karangtengah Village, Kediri District, faces challenges, particularly around the Konto River, due to regulations governing riverbank boundaries outlined in Ministry of Public Works and Housing Regulation No. 28/2015. This complexity arises from improper land use along riverbanks. This research explores the issuance of land certificates through PTSL in 2022 along the Konto River banks in Karangtengah Village, Kediri District. Using a qualitative descriptive approach, the study investigates the implementation process, the chronology of certificate issuance, factors influencing issuance on riverbanks, and proposes solutions to rectify discrepancies. This study provides insights into land governance, particularly concerning challenges and solutions related to land certification near riverbank boundaries in Indonesia.
