Abstract

Land acquisition for the public interest is carried out by the government in acquiring land for certain purposes by providing compensation to the entitled parties. The provision of compensation to the entitled parties often raises new problems, one of which is land owned by the community that is only partially used so that compensation is not given in its entirety to the land plot owned by the community, but only compensation for part of the land affected by land acquisition, hereinafter referred to as residual land. This research was conducted using a qualitative method to determine the implementation of compensation for residual land with an area of more than 100 m2 in the construction of SUTET sites in Boyolali Regency based on the criteria in ‘Peraturan Menteri Agraria dan Tata Ruang/ Kepala Badan Pertanahan Nasional Nomor 19 Tahun 2021’. Researchers also examined problems and solutions in the implementation of land compensation for the remaining land area of more than 100 m2 of SUTET site land acquisition in Boyolali Regency. The results showed that there were 14 community requests addressed to the chief executive of land acquisition so that the remaining land owned by the community was given compensation, but only 3 requests could be given compensation for some of the remaining land owned by the community. Problems in providing compensation for residual land with an area of more than 100 m2 include: (1) No budget, (2) Difficult coordination of the residual land study team, (3) No technical guidelines related to the settlement of residual land, (4) There are parties who disagree with the amount of compensation value by the appraiser. Solutions in overcoming the above problems are, (1) Budget adjustments and revision of planning documents, (2) Improving the coordination of the residual land study team, (3) The need for technical guidelines related to residual land settlement procedures, (4) Consignment.
