Abstract

The Bajo tribe community in Southeast Sulawesi Province can be found in Anaiwoi Village, Tanggetada District, Kolaka Regency, and is a maritime cultural community. The Bajo tribe who live in coastal areas still adhere to the cultural aspects of the Bajo tribe who live on the coast or in the air. For them, living on land, the sea is the source of life and the home of their ancestors. The origin of this land is more complex because most of it is state land used for public purposes. Therefore, it is very important for the state to have a legal role through regulations in this case, namely ownership, control and utilization are all included in the regulations, so that they are regulated logistically. This research aims to determine the process of publishing building use rights certificates in the Bajo Tribe organization, Anaiwoi Village, Tanggetada District, Kolaka Regency, Southeast Sulawesi Province. This research uses a qualitative method with a descriptive approach. The research results obtained by the Bajo Anaiwoi Tribe are a community that has lived in the waters for generations since 1960 with their livelihood tied to the sea, which of course is an issue for legal certainty in the form of land rights. In order to provide legal certainty, the Kolaka Regency Government is implementing a Building Use Rights Issuance Program. The program aims to improve the standard of living of the Bajo people in the water area. This program is implemented by the Central Government and the Kolaka Regency Land Office with a total budget for this program of IDR. 37 billion which is part of the integration of the 2023 Special Allocation Fund (DAK) covering an area of 8.73 ha. land plots with a total of 273 certificates issued. This publication process is carried out through the National Strategic Project, namely Complete Systematic Land Registration referring to the circular issued by the Ministry of Agrarian Affairs and Spatial Planning of the National Land Agency regarding the granting of land rights in coastal areas. Apart from that, through approval from the Ministry of Maritime Affairs and Fisheries for permits to utilize marine space.
