Abstract

Abandoned land is land that is not utilized and is not used according to its intended purpose. This causes inequality in the control, ownership, use and use of land, which is one of the strategic issues in land affairs. To overcome the problem of abandoned land, there are many regulations governing abandoned land, namely PP No. 20 of 2021, and Minister of ATR/KaBPN Regulation No. 20 of 2021. Even though there are already regulations governing abandoned land, currently there is still a lot of land that is indicated to be abandoned. Researchers took the case of PT. Citrawahana Rimba Kencana which is located in Pandeglang Regency, Banten Province as research material. This research aims to show the mechanisms and problems in controlling abandoned land and utilizing abandoned land for the purposes of agrarian reform. This research uses empirical legal methods. Data obtained in this research was obtained from primary data by means of interviews and secondary data from legal regulations, documents related to research, and the results of other scientific work. The results of this research show that the process of controlling abandoned land for Cultivation Rights No.1/Pandeglang was carried out starting in 2010 until the determination of abandoned land in 2022. The period for controlling abandoned land, which took up to 8 years, was caused by obstacles and constraints in the process. controlling abandoned land includes: the whereabouts of the right holders are not known, there is community control and land claims in the HGU area, and limited government budget for controlling and utilizing abandoned land. Utilization of State General Reserve Lands of former abandoned land, former Cultivation Rights No.1/Pandeglang was carried out starting in 2010 until the determination of abandoned in the name of PT. Citrawahana Rimba Kencana covering an area of 185.05 Ha is designated as: Agrarian Reform (80.05 Ha), Land Bank (100 Ha), and Other State Reserves (5 Ha).
