Abstract

Jakarta Administrative City to Kampung Melayu East Jakarta Administrative City is based on the needs of the Ciliwung Cisadane River Basin Center which delegates its duties to the Water Resources Service, which then coordinates with the South Jakarta National Land Agency. to carry out the stages of land acquisition professionally. Land acquisition Normalization of Ciliwung River Jl. TB Simatupang, South Jakarta Administrative City to Kampung Melayu, East Jakarta Administrative City, has been implemented since 2014 and is currently still ongoing and has not yet been completed. The implementation of land acquisition for the Normalization of the Ciliwung River is experiencing delays. Delays in implementing land acquisition are caused by obstacles that occur during the land acquisition process. The late implementation of land acquisition resulted in the construction of the Ciliwung River Normalization project in the form of concrete sheet pile walls being stopped and hampered. The aim of this research is to analyze the legal basis used, implementation progress, inhibiting factors, and provide alternatives for resolving obstacles to land acquisition for the Normalization of the Ciliwung River in South Jakarta. The research method used in this research uses a qualitative method with an observational approach. The data used in this research uses primary data and secondary data. Primary data was obtained from interviews and observations. The interviews carried out were by interviewing the land procurement implementer at the South Jakarta Land Office, the Water Resources Service as the agency requiring the land, and the parties entitled to it. Meanwhile, secondary data was obtained from document studies, namely, land procurement regulations, Land Acquisition Planning Documents, and Decree on Determining the Location of Land Acquisition for the Normalization of the Ciliwung River. Apart from that, in this research a socio-legal analysis was carried out. Socio-legal analysis is an analysis that combines various aspects of scientific disciplines, namely social science and legal science to find out the problems that occur in an activity. The research results obtained are that the implementation of land acquisition for the Normalization of the Ciliwung River is in accordance with land procurement provisions, namely, Law Number 2 of 2012, government regulation Number 19 of 2021, and Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 19 of 2021 Except, in the planning stage, the content of the Land Acquisition Planning Document which was prepared was not in accordance with the provisions of Law Number 2 of 2012. The progress of implementing land acquisition for the Normalization of the Ciliwung River in South Jakarta up to April 2024 is still below 50%. plots of land that have not yet been acquired. Factors inhibiting the implementation of land acquisition for the Normalization of the Ciliwung River in South Jakarta include poor Land Acquisition Planning Documents, inadequate Land Acquisition Budget, land disputes, and Completeness of Documents, Process Requirements and Information. The solutions provided regarding obstacles to the implementation of land acquisition for the Normalization of the Ciliwung River in South Jakarta are, Updating the Land Acquisition Planning Document by carrying out detailed planning and shortening the area of land acquisition locations according to the available budget, Resolving land dispute problems in stages, Carrying out socialization to the community with the help of village officials, and improving the quality of services at the South Jakarta Administrative City Land Office.
