Abstract

Article 15 of the UUPA explains that every person who has a legal relationship with land is obliged to maintain the land and prevent its damage, but there are some people who do not carry out these obligations so that they cause agrarian conflicts. Based on the KPA in the 2023 endsheet of year, it is explained that during 2015- 2023 there were 2.939 agrarian conflicts, one of which was regarding the issue of HGU ownership status. East Java Province is the region with the highest number of cases, namely 60 cases of agrarian conflict. One of them is the conflict of control and ownership of the former HGU land located in Soso Village, Gandusari District, Blitar Regency with the name of the rights holder PT Kismo Handayani. This study aims to find out how the history of conflicts, mechanisms, obstacles and solutions in conflict resolution and access management after asset structuring (land redistribution). The research method used is qualitative with a descriptive approach. The result of this study is that the conflict that occurred between PT Kismo Handayani and the people of Soso Village was motivated by the non-realization of the provisions of the Decree of the Minister of Agriculture and Agrarian Number 49/Ka/64 and the uncertainty of the status of plantation land rights. Efforts to resolve conflicts are supported by the Regent of Blitar by forming 2 teams, namely the Blitar Regency GTRA Team and the Blitar Regency Land Dispute Resolution Facilitation Team. Efforts to resolve conflicts are guided by Presidential Regulation Number 86 of 2018 concerning Agrarian Reform and are carried out through asset reform (land redistribution) then continued access reform.
