Abstract

Control of land in a forest area takes place before the land is designated as a forest area. Land control gives authority to the controlling party to exploit, use and cultivate the controlled land. Communities control land in forest areas to meet their daily needs. Land control in forest areas has been around for a long time, but they have not yet resolved the community's rights and the legality of the land they control. Changes in regulations and policies since the issuance of Law Number 11 of 2020 concerning Ombnibus Law and its derivative regulations have become a new chapter in solving this problem. This research aims to examine differences in regulations before and after UUCK, implementation of PPTPKH activities, and obstacles and solutions to existing problems. This research uses two research methods, namely qualitative with a descriptive approach and juridical with a comparative approach. The techniques used in writing this research used observation techniques, interviews, and document studies with regulatory comparisons. The research results show that there are several differences in the regulations before and after UUCK, the implementation of PPTPKH is in accordance with current regulations, and obstacles are found in implementation and solutions are found to resolve them. The settlement pattern uses a forest area release and social forestry scheme. The conclusion of this research is that PPTPKH can be implemented on the island of Java using regulations after UUCK. Currently, the land plots resulting from PPTPKH have been redistributed to the community and have received legality recognized by the state. Keywords: PPTPKH, agrarian reform, Banyuwangi Regency
