Abstract

The Basic Agrarian Law provides legal certainty regarding land rights for the people. Therefore, it is necessary to change or adjust the type of right. Due to the land registration process that has not been fully implemented and the lack of knowledge and awareness of the community, the adjustment of the type of right has not been fully implemented. The majority of the lands located along the banks of the Progo River have proof of Letter C. The Progo River area has several problems related to environmental conditions in the aspect of controlling and overcoming water destructive power, including routine flooding problems in several areas, mining of C excavation materials along the river, and many landslides or erosion of riverbanks. In addition, abrasion and sedimentation problems in the estuary and southern coastal areas of the river area are prone to tsunami hazards. This can certainly cause problems related to the status of the land on the banks of the Progo River. This research aims to explain how the application of the criteria for land destruction according to applicable regulations and the legal protection of land ownership indicated to be destroyed with Letter C rights. Qualitative data searches were carried out by observation and in-depth interviews in addition to analyzing document studies. The results of this study indicate that the application of Government Regulation No. 18 of 2021 in article 66, in conjunction with Regulation of the ATR/BPN No. 17 of 2021 to lands indicated as destroyed in Banaran Sub-district is not fully included in the criteria of the regulation. The lands indicated to be destroyed in Banaran sub-district, Kapanewon Galur are caused not only by natural phenomena (erosion) but also by excessive mining activities. The lands on the banks of the Progo River have the potential carrying capacity for land use development without overriding the conservation of river water resources. The government or the state has not fully provided legal protection for land ownership with the old Letter C evidence that is indicated to be destroyed on the banks of the Progo River Preventive legal protection (prevention) for landowners to make various preventive efforts.
