Abstract

Based on the researcher's initial observations, in the implementation of land acquisition for the construction of the Solo-Yogyakarta toll road at the Boyolali Regency Land Office, problems were found regarding the unclear status of land used by Dutch plantation companies or onderneming ground (OG). This problem hampers efforts to implement land compensation. The research method used is a qualitative research method with an empirical juridical approach to determine the status of OG land, the process of providing compensation, problems and resolution of providing compensation to parties entitled to OG land. The research results show that the status of the former OG land at los no. 21 Kateguhan is the land of an unfree country. The implementation of providing compensation is carried out separately between ownership compensation and possession compensation. The cultivator only receives compensation for business losses or planting on OG land. The problem of unclear land status can be resolved by filing a lawsuit with the District Court or re-coordination to prove that OG land is part of PTPN (BUMN) assets. If the OG land is recorded as an asset, compensation is carried out after the asset is written off, but if it is not recorded, the compensation asset can be based on a physical possession letter in good faith.
