Abstract

Since the issuance of the UUPA, the implementation of customary land registration in Indonesia has not been optimal. The Ministry of ATR/BPN then carried out an inventory and identification of customary land in 2021. The results of the inventory and identification were followed up with a pilot project for administering nagari customary land in Limapuluh Kota Regency and Tanah Datar Regency in 2023. This research uses empirical normative legal research methods with legal sociology approach, conceptual approach, and comparative legal approach. This research aims to determine the mechanism for administering ulayat nagari land, the factors that influence the process of administering ulayat nagari land, and to find out the regulation of ulayat land in Indonesia after the administration of ulayat nagari land. The research results show that the mechanisms implemented include inventory and identification, socialization of activities, installation of boundary markers, measurement and mapping, recording in the land register and issuing management rights certificates, and handing over certificates. Supporting factors for the pilot project for administering Nagari customary land are the MHA's desire to obtain legal certainty of rights to their customary land, the availability of a budget, and increasing government attention to MHA and their customary land. The inhibiting factors are the lack of agreement on customary land boundaries, the absence of a decision letter from the regional head regarding MHA, and the existence of dualism in KAN management. The administration of nagari customary land has legal, political, economic and socio-cultural impacts. These four impacts are very beneficial for MHA.
