Abstract

One of the issues in determining abandoned land is that land that has been designated as abandoned land faces a lawsuit in court from the rights holder, even though physically the abandoned land object is not being used according to its intended purpose. The aim of this research is to examine the process of controlling abandoned land with a focus on the case of Building Use Rights (HGB) belonging to PT Kadu Gedong Raya and PT Banten West Java. This research highlights the mechanism for implementing abandoned land control in the field, identifies the obstacles faced during the process, and offers solutions that can be implemented to overcome existing problems. This research is important to provide a clearer understanding of how regulations related to abandoned land are implemented and their effectiveness in dealing with land disputes. The research method used is qualitative research with a case study approach. This method was chosen to get a more in-depth picture of the implementation of controlling abandoned land in Pandeglang Regency. Data collection was carried out through field observations, interviews with related parties, as well as reviewing official documents relevant to government regulations regarding control of abandoned land. The results of the research show that the implementation of controlling abandoned land in Pandeglang Regency has followed the stages set out in Government Regulation Number 11 of 2010 and Government Regulation Number 20 of 2021. However, the process of determining abandoned land belonging to PT Kadu Gedong Raya HGB which has lasted 10 years is considered to be too old. and has the potential to cause new problems. The main factors causing land to be indicated as abandoned include economic problems, lack of investors, and land control by local communities.
