Abstract

The issue of land ownership within forest areas by local communities, especially in Java, presents a complex challenge. This situation is also evident in Cimrutu and Rawaapu Village, located in the Patimuan sub district of Cilacap Regency. In these areas, communities have occupied the entire forest land, making it impossible for Perum Perhutani (the state-owned forestry company) to manage the forest effectively. The struggle to clarify land rights has persisted for decades, hindered by regulations that require compensation when forest land is released. With the enactment of the Undang Undang Cipta Kerja (UUCK), community ownership of land within forest areas can now be released without the need for compensation, particularly for land used for settlements. This is achieved through the Penyelesaian Penguasaan Tanah Dalam Rangka Penataan Kawasan Hutan (PPTPKH) scheme. Research aims to explore the intricacies of forest tenure conflicts, the implementation of the PPTPKH program, and the resolution of land ownership within forest areas, specifically focusing on cultivated land. The study adopts a qualitative approach with descriptive and empirical legal analysis. Findings indicate that forest tenure conflicts in Cimrutu and Rawaapu Village date back to around 1967 when communities began occupying forest land. Despite broadly adhering to regulations, there are discrepancies, particularly regarding proposals for land used as cultivated areas. The resolution of land ownership within forest areas, in the form of cultivated land, is facilitated through the Perhutanan Sosial (Social Forestry) scheme, governed by The Ministry of forestry and Environment Regulation No. 4 of 2023.
