Abstract

In order to resolve disputes, it is divided into two ways, namely through the court and outside the court. The Banyuwangi Regency Land Office is one of the Land Offices that has a large number of complaints related to land disputes and acts as a mediator in dispute resolution. Although mediation is used as a dispute resolution method that is considered effective, public interest in out-of-court settlements is still lacking so that many people prefer to resolve problems through litigation. Therefore, there is a need for this research to conduct a more in-depth study of land dispute resolution through mediation in order to measure the efficiency of land dispute resolution through mediation and determine the factors that hinder land dispute resolution. The method used in this research is to apply a qualitative approach using a comparative method. The findings obtained are that the efficiency comparison shows that the non-litigation route requires 3 mediations with a duration of 3 hours per mediation while the litigation route requires 16 mediations with a duration of 5 hours per mediation. In terms of costs, the non-litigation dispute resolution requires lower transportation and consumption costs than the litigation dispute resolution. However, dispute resolution through mediation at the Banyuwangi Regency Land Office still experiences challenges, such as difficulties in finding important documents, the absence of the parties, lack of willingness to reconcile, and disagreement with the proposed settlement options.
