Abstract

Law Number 4 of 1996 on Mortgage Rightsserves as the legal basis for the collateral binding with land and all objects related to it. The Mortgage Rights Agreement is an ancillary agreement (accessory) to the principal agreement, which is the credit agreement, documented in a Mortgage Rights Deed made before a Land Deed Official. The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) implements this requirement, among other things, through the integrated electronic Mortgage Rights service that must be applied by all Land Offices. The Pandeglang District Land Office frequently encounters issues related to requirements and procedures that do not comply with regulations, leading to the closure of the case files. The research problem is to identify the challenges faced, the users' responses to the quality of HT-el services, and the compliance of the implementation mechanisms with regulations. This research aims to assess the alignment of the HT-el service mechanisms and challenges as regulated by Ministerial Regulation ATR/BPN No. 5 of 2020 with its practice at the Pandeglang District Land Office. Additionally, it explores how the Pandeglang Land Office addresses obstacles in HT-el implementation. This study uses a qualitative research method with a descriptive approach. The findings indicate that the evaluation of HT-el service implementation at the Pandeglang District Land Office still encounters challenges during execution. In conclusion, case file closures occur due to errors by HT-el system users, such as failure to proceed with the issuance of the Payment Instruction Letter (SPS) and Non-Tax State Revenue (PNBP) payments, as well as not making corrections after the specified deadline.
