Abstract

The contradictory delimitation principle is a principle implemented by the applicant together with the neighboring landowners in the process of approving and installing land boundary markers. The implementation of the contradictory delimitation principle in sporadic land registration reflects the importance of involving neighboring landowners. Permen ATR/KBPN No. 16 of 2021 is the third amendment to PMNA/KA.BPN No. 3 of 1997. This regulation further regulates the installation and determination of land boundary markers, inserting four articles between Articles 19 and 20, namely Articles 19A, 19B, 19C, and 19D. The issue arising from this regulation is the gap or difference in the application procedures of the contradictory delimitation principle between PMNA/KA.BPN No. 3 of 1997 and Permen ATR/KBPN No. 16 of 2021. This has led to problems related to the differences in the implementation of the contradictory delimitation principle between PMNA/KA.BPN No. 3 of 1997 and Permen ATR/KBPN No. 16 of 2021, and an evaluation of the implementation and application of the contradictory delimitation principle according to these regulations. This research employs a qualitative method with a descriptive approach to evaluate the implementation of the contradictory delimitation principle in sporadic land registration according to Permen ATR/KBPN No. 16 of 2021. Data collection techniques include observation, interviews, and documentation. The evaluation criteria are based on policy evaluation by William Dunn (2003), which consists of effectiveness, efficiency, adequacy, equity, and responsiveness. The research was conducted in Pati Regency and the Pati Land Office. Pati Regency was chosen because it had 5,448 sporadic registration services in 2023 (Kantah Pati Performance Report, 2023). Based on the analysis and discussion, this study concludes that the implementation of the contradictory delimitation principle in sporadic land registration in Pati Regency has been partially carried out. The presence of supporting documents such as the Boundary Marker Installation Statement and Neighboring Owner’s Approval, complemented by geotagged photo documentation, has made the survey and measurement process more efficient. Increased socialization and coordination have also provided the community with a better understanding of the importance of proper boundary marker installation. Overall, the implementation of this principle in Pati Regency has shown improvements in effectiveness, efficiency, adequacy, equity, responsiveness, and accuracy in the sporadic land registration process, as well as reducing potential boundary disputes and speeding up field survey processes.
