Abstract

Certificate is a strong piece of evidence regarding land rights that guarantees legal certainty. Legal certainty can be achieved when all aspects related to ownership, control, and changes in the certificate are registered. One of the changes in land registration data is physical data changes that can be requested through the subdivision of land plots. Cases of master certificates or residual plots whose areas do not match after land plot subdivisions were found at the Land Office of Ogan Komering Ulu Regency. This research uses a descriptive method with a qualitative approach aimed at evaluating the process of land plot subdivision and identifying factors that cause differences in land area after partial subdivision. The results of this study indicate that the implementation of land plot subdivision at the Land Office of Ogan Komering Ulu Regency has not been fully carried out in accordance with applicable regulations, as there are still incomplete requirements and officers who are not thorough in examining application files, as well as the absence of land plot boundaries and Survey Maps as measurement references. Furthermore, the difference in the area of the parent or residual land plot after subdivision is caused by the absence of boundary markers and the measurement of new boundary markers, as well as differences in measuring instruments and area calculation methods. The difference in the area of existing or factual land plots compared to what is stated in the certificate will certainly cause problems in the future.
