Abstract

Kendari Bay is one of the strategic areas of economic and environmental interest that has been designated as a Central Business District (CBD) under District Regulations No. 21 of 2021. However, in its implementation, inconsistencies are often found between existing land use and established spatial planning, which can hinder the authorization process. These inconsistencies can lead to various problems, such as increased land use conflicts, decreased environmental quality, and difficulties in obtaining business permits. The objectives of this research are: (1) To determine the suitability and non-conformity of existing land use with the RDTR in the designated CBD area; (2) To identify the factors contributing to the suitability or non-conformity of existing land use with the RDTR in the Kendari Bay CBD area; (3) To assess the impact of land use suitability on the ease of obtaining business permits. The research method used is a mixed-methods approach with a sequential explanatory design. The approach utilized in this study is a spatial approach with spatial analysis and interpretive analysis. The spatial approach involves spatial overlay analysis, including land use data and RDTR (Detailed Spatial Plan). Interpretive analysis is derived from interview results and field observations. The results of this study are as follows: (1) The suitability of existing land use with the RDTR shows that 98.46% is compliant, while 1.54% is non-compliant; (2) Factors contributing to the suitability of land use in the Kendari Bay CBD area include alignment of land use with existing conditions, government policies, law enforcement, and cooperation between the government and the community. Conversely, minimal coordination and communication between government agencies and local communities leads to non-compliance in land use; (3) The alignment of existing land use with the RDTR positively influences the ease of obtaining business permits in the Kendari Bay CBD area, resulting in a faster and simpler permitting process, as well as legal certainty and investment security. On the other hand, non-compliant land use has a negative impact on the permitting process, resulting in delays and potential penalties for violations of land use regulations.
