Abstract

Indonesia, in its efforts to boost economic growth, has established a regulation through Law No. 6 of 2023 on the Ratification of Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation into Law. This regulation addresses investment facilitation by streamlining licensing processes. According to this regulation, it is hoped that the vision and mission of the National Long-Term Development Plan (RPJPN) 2025-2045 will be achieved, supporting the implementation of Indonesia’s Golden Vision 2045. The implementation of Spatial Utilization Compliance (KKPR) in the Banyakan-Grogol Urban Area is being conducted intensively following the Detailed Spatial Plan for the Banyakan-Grogol Urban Area, with the expectation of supporting regional development into an urban area since the establishment of Dhoho Kediri Airport and the Kediri-Kertosono Toll Road in Kediri Regency. Issues related to human resources, systems and work procedures, institutions, and challenges faced by business and non-business actors in processing KKPR applications are the reasons for this research. The research method used is qualitative, with a normative juridical analysis approach based on legislation. The applicable regulations for the implementation of Spatial Utilization Compliance (KKPR) include Government Regulation No. 21 of 2021 and Minister of Agrarian Affairs and Spatial Planning/Head of National Land Agency Regulation No. 13 of 2021. In addition to regulations, other relevant documents related to the implementation, such as technical guidelines for KKPR, serve as supporting data for the research, allowing the analysis to develop. Data collection techniques involve analyzing and validating the accuracy of information until it becomes reliable data for written interpretation. The results of the research include the implementation, process flow, and the obstacles and solutions encountered in the licensing of Spatial Utilization Compliance (KKPR) carried out in the Banyakan and Grogol sub-districts. The implementation of KKPR in the Banyakan-Grogol Urban Area has been conducted through KKPR Approval (PKKPR), involving the implementing agencies such as the Public Works and Spatial Planning Office (PUPR), the Investment and One-Stop Integrated Services Office (DPMPTSP), and the Kediri Regency Land Office. The standard operating procedures for PKKPR implementation have been followed according to regulations, although the process has faced issues such as a shortage of human resources, incomplete integration of the Detailed Spatial Plan (RDTR) since 2023, overlapping institutional roles, and confusion among business actors in carrying out KKPR. Therefore, the involvement of the agencies in providing alternative solutions to these problems is crucial for resolving the issues. Keywords: Undang-Undang Cipta Kerja, KKPR, PKKPR
