Abstract

The process of issuing land ownership certificates quickly and affordably is an urgent need for land owners. This is in line with the principles of land registration that prioritize simplicity and affordability. Responding to this need, the government has initiated the Complete Systematic Land Registration Program (PTSL) as part of the National Priority Program. However, the implementation of PTSL does not always run smoothly. One of the land issues and government policies in the implementation of the PTSL program is related to the legal certainty of the PTSL products themselves, due to the overlapping land ownership between the PTSL certificates and the old certificates. This research aims to determine the causes of overlapping land ownership, the impact of overlapping land ownership, as well as efforts to resolve the overlapping land ownership in the objects of the Complete Systematic Land Registration in Bintan Regency. To achieve these objectives, the research uses a descriptive qualitative research method, with data collection techniques in the form of interviews and document studies. The research results show that the causes of overlapping land ownership in the PTSL objects in Bintan Regency are the increasing number of PTSL targets, the suboptimal implementation of PTSL technical guidelines, the incomplete mapping of registration maps, the suboptimal village administrative system, and mistakes made by the land owners themselves. The impact of the overlapping land ownership in the PTSL objects in Bintan Regency includes the inability to perform legal acts, the emergence of legal uncertainty, the emergence of concerns for certificate holders, and the failure to achieve the orderly administration of land affairs. The efforts to resolve the overlapping land ownership in the PTSL objects in Bintan Regency are carried out through non-litigation channels, in the form of mediation, and through the litigation channel in the court.
