Abstract

Problems in the land sector often occur in Indonesia, one of the problems that often occurs is Abandoned Land. The problem of the abandoned land phenomenon shows that there are no clear criteria, both regarding the subject, object and time period which significantly indicate that a land is called abandoned land. This has resulted in an increasing number of land cases in Indonesia. This research aims to determine the mechanisms and problems in controlling abandoned land, especially in the Central Java region. The object of this research is a HGB in the name of PT Tanah Mas Duaja located in Semarang City which was carried out to control abandoned land in 2014. The method used in this research is a qualitative research method with a descriptive approach. Primary data for this research was obtained through interviews and observations and secondary data was obtained through document study. The results of this research show that the mechanism implemented in the process of controlling abandoned HGB land in the name of PT. Tanah Mas Duaja starts from the inventory stage of land indicated as abandoned to the proposal to designate abandoned land and then the proposal to determine abandoned land is withdrawn. This was caused by problems that occurred in the process of controlling abandoned land, namely: misperception by PT. Tanah Mas Duaja and the ineffective implementation of Government Regulation Number 11 of 2010. Keywords: Abandoned land, Building Rights, Implementation.
