Abstract

Infrastructure development for the public interest requires effective land acquisition to realize facilities and infrastructure, such as the construction of ring roads and other public facilities. According to Imam Koeswahyono, land acquisition is a legal action by the government to acquire land by providing compensation in accordance with the procedures regulated in Government Regulation Number 19 of 2021. Land used in public development consists of various types of statuses: State Land, Land Rights, and Customary Land. The land acquisition process aims to create synergy and efficiency, as well as avoid conflicts between sectors that can harm the wider community. In the procurement of land for the public interest, the government, local governments, and state-owned or regional enterprises that are given special assignments are involved in the stages of planning, preparation, implementation, and delivery of results by land institutions. This process involves deliberations to reach an agreement on compensation, which can be in the form of money, replacement land, resettlement, or the construction of public facilities. The construction of a ring road in Sorong Regency, Southwest Papua, is one of the National Strategic Projects (PSN) to increase road capacity and traffic flow. However, the land acquisition for this project faces challenges, especially related to customary land belonging to customary law communities. Customary land ownership, according to customary law, is a common right managed by tribal chiefs and inherited from generation to generation. In practice, the government often faces difficulties in releasing customary land, causing problems such as road closures by the community.
