Abstract

This thesis examines the disputes arising from overlapping land ownership rights registered through the Complete Systematic Land Registration Program (PTSL) and sporadic land registration in Gagasari Village, Gebang District, Cirebon Regency. These overlapping rights occur due to differences in procedures and the accelerated process of land registration under the PTSL program, often conducted without thorough verification of existing data. This situation risks lowering the quality of legal products and causing conflicts among landowners holding duplicate certificates for the same plot of land. This research uses a case study approach with qualitative methods, collecting data through in-depth interviews, observations, and analysis of related documents. The research aims to identify the factors causing the disputes and evaluate the effectiveness of dispute resolution methods, whether through litigation or non-litigation means. The study's findings reveal that the main causes of overlapping certificates are administrative errors at the land office and insufficient socialization of the PTSL program to the public. To resolve these disputes, mediation and deliberation are prioritized, involving various related parties such as landowners, land office officials, and village government. Non-litigation efforts are considered more effective in achieving peaceful agreements and preventing further conflicts.
