Abstract

Land is a basic need for every human being in life in society, however, problems often arise regarding land the. One example is the case of ownership of land rights between KUD Lestari Makmur with the Tempeh Tengah Village Government. Research purposes is to find out the problem, to know the factors behind the decision of the State Administrative Court and whether the principle of horizontal separation can be implemented for buildings on land from this decision. The method used in this research is a doctrinal normative research method or dogmatic study using a case approach. Data was obtained through document study and direct interviews with the Head of the Dispute Control and Handling Section at the Lumajang Regency Land Office. The research results found that Decision no. 107/G/2023/PTUN.SBY stated that the plaintiff's claim was not accepted and the plaintiff was required to pay a fee. The factors behind the decision are the judge's considerations and the type of State Administrative case.
