Abstract

Basically, Land Acquisition for Public Interest is carried out by referring to Law Number 2 of 2012. Furthermore, land acquisition for the construction of the Kediri-Tulungagung Toll Road is land acquisition for public interest which must be carried out in accordance with the guidelines of the law. The Kediri-Tulungagung Toll Road construction project was built referring to the provisions of Article 81 of the Regulation of the Minister of ATR/BPN Number 19 of 2021. The Kediri-Tulungagung Toll Road project is included in the national strategic program, in the context of national development with accelerated development of strategic areas such as facilitating access to Dhoho Kediri Airport, however, in the construction of this Toll Road by 2 parties, namely from the Private Sector, namely from PT Gudang Garam Tbk as the Implementing Team and the Government which is marked by a Guarantee Agreement for the construction of the Toll Road, with an agreement that has been made and signed directly by Basuki Hadimuljono as the Minister of PUPR at the PUPR Ministry's Auditorium Building. The signing of the agreement was carried out jointly by the Toll Road Regulatory Agency and PT. Surya Sapta Agung Tol and related parties who were also present were the Secretary General of PUPR Mohammad Zainal Fatah, Director General of Highways Hedy Rahadian, and representatives from the Secretary of the Governor of East Java Province. Based on the agreement above, a Letter from the Minister of Public Works and Public Housing (PUPR) Number PB 0201- Mn2954 was issued, which discussed the winner of the Kediri-Tulungagung Toll Road project tender, namely PT Gudang Garam (Tbk) next, by the PT initiator team. Gudang Garam (Tbk) then created and established a Toll Road Business Entity (BUJT) with the name of the agency PT Surya Aung Tol to carry out the construction of the national strategic project of the Kediri-Tulungagung Toll Road. The construction of the Kediri-Tulungagung Toll Road initiated by PT. Gudam Garam Tbk with a toll road construction area of 44.17 km2 which crosses 3 districts/cities, namely Kediri City, Kediri Regency and Tulungagung Regency. In phase 1, it has been running although its implementation has not been completed in 8 (eight) sub-districts in Kediri City including Semampir Village which is the location of this research. Based on the observation and discussion of Sub-Chapter A above, the problems of land acquisition for public interest for the construction of the Kediri - Tulungagung toll road segment in Semampir Village have been identified as follows. Measuring plots of land and making work maps, The land owner does not know the boundaries of the land plot, There is a difference between the measured land area and the area number on the land certificate, The need to restore land ownership boundaries, Issuance of land area maps, Legal data collection by Task Force B, Making announcement of nominee list, Deliberation on approval of form of compensation for land acquisition and Release of rights and payment of compensation.
