Abstract

Kampung Heritage Kayutangan in Malang City is a historic area that developed as a colonial district and now serves as a heritage tourism destination, yet it faces issues related to land tenure and spatial planning. Although the Basic Agrarian Law of 1960 regulates the unification of land laws, in reality, many old land rights in Kayutangan remain unconverted. This study aims to uncover the historical formation of the area, analyze land tenure issues, evaluate spatial planning efforts, and explain the correlation between land tenure problems and spatial planning. The research employs a qualitative descriptive method with a case study approach, using data collection techniques such as interviews, field observations, and document analysis. The findings reveal that many residents still hold land based on customary rights documented in Verponding Indonesia and former Western rights such as eigendom, and several ex-Dutch assets (P3MB) remain unresolved. Spatial planning aligned with Rencana Tata Ruang Wilayah (RTRW) requires initial steps in resolving land tenure issues through formal land registration, which serves as a legal foundation for development, cultural heritage preservation, and legal certainty for the community.
