Abstract

This study aims to compare the tenurial systems and cultural constructions of two indigenous communities in Witihama District, Adonara Island namely, the Goran Tokan and Lama Tokan clans in their perceptions of land ownership certificates. Employing a qualitative ethnographic approach, the research was conducted through participant observation, in-depth interviews, and document analysis. The findings reveal that both clans perceive land not merely as an economic asset, but as a sacred entity inherited through kinship and governed by customary law. Land serves as a symbol of collective identity, binding the people to their ancestors and to the natural environment. Within the local sociopolitical structure, the Lama Tokan clan acts as the land-owning group (lewo alapen), while the Goran Tokan clan holds the status of nobility (ata kebelen) with traditional privileges in resource management. Both play vital roles in land ownership and inheritance, although they differ in their views on legal land certification. Some community members recognize land certificates as important for legal certainty and protection, while others continue to rely on customary legitimacy as the ultimate source of authority. This research underscores the importance of adaptive and culturally sensitive land policies. It highlights the need for meaningful integration between state legal systems and customary institutions to ensure inclusive and equitable agrarian justice. Understanding local tenurial systems is therefore essential not only for academic inquiry but also for shaping policies that uphold indigenous rights and promote sustainable land governance.
