Abstract

The results of the TORA data collection activity, as part of the land redistribution program, contribute significantly to supporting the implementation of agrarian reform. This data collection serves as a preparatory step in providing TORA objects through land redistribution schemes aimed at ensuring legal certainty for communities who have occupied state land without possessory rights that can be converted. In practice, the data collected often does not fully align with the intended outcomes of agrarian reform. This research employs a descriptive qualitative approach, using data collection methods including interviews, document analysis, and field observation. The findings indicate that the state land occupied by local residents originates from former forest areas that have been converted into agricultural and residential use, and has been controlled over generations without any formal proof of ownership. Based on legal, subject, and spatial analyses, most of the identified land and occupants meet the criteria as recipients of land redistribution under Presidential Regulation No. 62 of 2023. However, several subjects require further assessment, particularly regarding domicile and employment status. Spatially, the land lies outside designated forest areas, has favorable physical characteristics for agricultural activities, and aligns with the regional spatial plan (RTRW). The implementation of TORA data collection has proven to provide a solid foundation in preventing overlapping claims and unauthorized applications for land rights, while promoting agrarian justice. Thus, the results of this TORA data collection have a meaningful impact in accelerating the implementation of agrarian reform and ensuring targeted provision of TORA land.
