Abstract

Land disputes that often occur in society include overlapping land rights ownership (Overlapping). Like the case that occurred at the Lebak Regency Land Office, located in Bojongleles Village, Cibadak District, Lebak Regency. The government issued a policy in resolving land disputes in one way, namely mediation. The Lebak Regency Land Office has the authority to handle problems in the land sector and acts as a mediator in leading the mediation process. The purpose of this study was to determine the factors causing overlapping land rights ownership disputes (Overlapping) at the Lebak Regency Land Office and to determine the process and steps taken in resolving overlapping land rights ownership disputes (Overlapping). The results of the study show that the factors causing overlapping land rights ownership are the failure to maintain land boundary markers by the land owner; there are indications of errors by the land owner in indicating boundaries, ownership boundaries; errors by the BPN in inputting land data; the existence of regional expansion that is not followed by land data maintenance. Settlement of disputes over overlapping land rights ownership (Overlapping) between Certificate of Ownership Number 293/Kaduagung and Certificate of Ownership 1128/Bojongleles, after a mediation process, the results agreed upon by both parties were compensation and release of rights.
