Abstract
The settlement of land cases often experiences obstacles due to the complexity of multidimensional problems and the not optimal competence of judges in handling land cases. A special land court was designed as a solution by the government in handling land cases. However, the idea of establishing a special land court or with ad hoc judges experienced rejection, ranging from academics to the Supreme Court itself. Finally, a policy emerged to improve the competence of judges through the Land and Spatial Planning Judge Certification program. This research aims to understand the urgency of the policy and implementation of the Certification of Land and Spatial Judges, as well as to know the direction of the empowerment policy for certified judges. This research uses normative - empirical legal methods. Normative studies are conducted through a search of laws and regulations related to land and judicial power, official documents issued by the organizing agency for the Certification of Land and Spatial Judges, and relevant legal literature available in libraries and the internet. Meanwhile, the empirical aspect is obtained through data collection in the field by means of interviews with parties who understand or are directly involved in the implementation of the Certification of Land and Spatial Judges. The result of this research is the Certification of Land and Spatial Planning Judges motivated by several court decisions that override customary law that applies in several regions. Other problems arise from the existence of tangents in adjudicating land cases by 2 (two) judicial institutions on the object of the case in the form of certificates of land rights, as well as differences in legal interpretation of laws and regulations among judges often become a separate problem in judicial practice. Certification of Land and Spatial Planning Judges is carried out through administrative, competency and integrity selection, as well as training. In its first implementation, it was carried out effectively, but several obstacles were still found, including training subjects that were still considered too heavy by participants, participants who were not honest in taking the exam, and budget limitations for the next implementation. Therefore, it is important to encourage more judges to qualify as land and spatial judges through the Land and Spatial Judge Certification program. This can be done by allocating special funds to ensure the sustainability of the judge certification program, increasing the number of land and spatial judges, so that regulations related to the empowerment of land and spatial judges can be formulated immediately.
