Abstract

Land acquisition for the Solo-Yogyakarta toll road, particularly in Ngawen Village, has not always gone smoothly, particularly for waqf land. Compensation for waqf land is provided through replacement land. The agency requiring the land seeks replacement land and then exchanges it with the waqf land affected by the land acquisition. The compensation process requires not only an agreement between the land-needing party and the entitled party but also a permit from the relevant ministry, namely the Ministry of Religius The purpose of this study is to understand the implementation of the waqf land exchange for the Solo-Yogyakarta toll road construction, so that problems and solutions can be identified. This research employs qualitative methods through empirical legal studies with a descriptive analytical approach. It explains the mechanism of the waqf land exchange for the construction of the Solo-Yogyakarta toll road in accordance with applicable legal provisions. Based on the analysis of the implementation of the exchange, problems and solutions can be identified. Data for this study were obtained through interviews, observation, and documents study. The results of this study are: first, in the implementation compensation of waqf land, permission must be obtained from the Ministry of Religion (Regional Office of the Ministry of Religion of the Province). Second, the problems of exchanging waqf land are the resignation of the nazhir, difficulty in finding replacement land, delays in issuing permits, delays in the construction of replacement buildings and waqf disputes. Third, the solution to overcome these problems is to replace the nazhir, determine the criteria for replacement land, hold coordination meetings with related parties and carry out deliberations in resolving waqf disputes.
