Abstract

Land registration aims to provide legal certainty, protect rights and ensure easily accessible information, and ensure orderly land administration. While the land registration process has historically used an analog system, over time and with technological advancements, the Indonesian government, specifically the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN), has adopted digital transformation in land services, including the issuance of electronic certificates. The implementation of digitalization policies in the land sector is based on Law No. 6 of 2023 and Regulation of the Minister of ATR/KBPN No. 3 of 2023. Government-owned land assets are a pilot project for electronic certificates. The Surabaya City Government has many uncertified land assets (3,032 out of 8,452 registered as of May 2024) and faces asset security issues, necessitating a transparent and accountable legalization system. Therefore, this study aims to determine the implementation of electronic certificate issuance for land assets belonging to the Surabaya City Government at the Surabaya City Land Office I. This study uses a descriptive qualitative method with a case study design. To analyze the implementation of electronic certificates, primary data was obtained through interviews and supported by secondary data obtained through document studies, including regulations, application documents, and output documents from the mechanism stages. The analysis of problems and solutions focused on communication, resources, disposition, and bureaucratic structures that influence policy implementation. The results of this data collection were categorized and conclusions drawn. The Surabaya City Land Office I has issued 330 electronic certificates for land assets belonging to the Surabaya City Government from 2024 to May 2025. The mechanism largely complies with Technical Instruction Number 10/Ins-HK.02.01/XII/2023, although some output is still manually generated. The main obstacles stem from a suboptimal system and external factors (incomplete documents or problems with land parcels). To achieve more effective and efficient land certification, the Surabaya City Land Office I has actively collaborated with the Data Center (Pusdatin) of the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) and the Surabaya City Government to classify land assets, prioritize "clean and clear" (K1) land parcels, and facilitate the resolution of problematic land parcels.
