Abstract

This study analyzes how the certification process of redistributed communal land functions as a means to fulfill land rights for former members of the Free Aceh Movement (GAM) in Aceh Besar Regency. The background of this research focuses on agrarian issues in post-conflict Aceh, where the recognition and protection of land rights play a crucial role in supporting the socio-economic reintegration of former combatants. Communal land certificates serve as legal instruments to provide legal certainty over collectively managed land and form part of the agrarian reform efforts and the implementation of the 2005 Helsinki Peace Agreement. The research methodology adopts a qualitative approach using document study and in-depth interview methods. The study was conducted in Jalin Village, Jantho Subdistrict, Aceh Besar Regency, with key informants from the Aceh Besar Land Office. The objectives of the study are to identify the beneficiaries of communal land redistribution, analyze the factors influencing the application for land certificates, and evaluate government policies related to the implementation of communal land certification for former GAM members. The findings of the study indicate that the communal land certification process is influenced by regulatory frameworks, inter-agency coordination, local community participation, and existing socio-political factors. The government, through the Aceh Reintegration Agency (BRA) and the Land Office, has played an important role in land redistribution, although challenges remain, such as overlapping regulations, limited beneficiary data, and the risk of agrarian conflict. This study recommends the need for strengthening specific regulations, enhancing institutional capacity, and involving communities in the certification process to ensure justice and sustainability in the communal land redistribution program.
