Abstract

Misuse of village land utilization not only gives rise to legal problems, but also has the potential to hinder the achievement of the initial goal of managing village land as a strategic asset that should be utilized for the benefit of the community. This study aims to identify the forms of misuse of village land, the implementation of supervision, and law enforcement against such misuse. This study uses an empirical legal method. This research method was chosen because the researcher wanted to observe the facts on the ground, including the behavior of the community itself, the government, and law enforcement officials. This evidence was obtained through direct observation, both physical and archival. The results of this study indicate that in Caturtunggal Village, there are five forms of misuse: use without a permit, without a permit, not in accordance with the permit, transferring the permit to another party, and not in accordance with the permit and transferring the permit to another party. Of the 46 cases, the majority were unpermitted, accounting for 32 cases. Supervision of village land use is carried out by the Sleman Regency Regional People's Representative Council (DPTR) and the Caturtunggal Village Government through direct methods, such as field inspections, and indirect methods using the Google Earth application. Law enforcement against misuse is carried out through administrative channels by local government officials before going to court, and after going to court by law enforcement officials when criminal elements and state losses are found. Based on these findings, this study recommends increasing human resource capacity at the village level, establishing a special monitoring team at the district level, and developing an integrated village land data system to strengthen governance, supervision, and law enforcement.
