Abstract

The Indonesian government guarantees legal certainty in the land sector through land registration. Land registration is regulated in PP No. 24 of 1997. The administration of President Joko Widodo issued a Complete Systematic Land Registration Program/Program Pendaftaran Tanah Sistematik Lengkap which covers extensive plots and increasing every year. This, of course, must be balanced with the availability of a large number of human resources. For this reason, BPN cooperates with third parties to carry out contradictoire delimitation land measurements. The Technical Guidance No: 01 / JUKNIS-300/1/2018 mentioned that the determination of the limit was carried out by the Adjudication Committee and SKB. This research used a qualitative method with a descriptive approach. The analysis technique used to compose logically proportional statements in answering research questions. Analysis of the problem carried out by making a description based on primary and secondary data obtained from interviews and observations. This research was conducted to determine the suitability between the implementation of the principle of contradictoire delimitation at the district of Sidoarjo and Pasuruan Land Office and PP No. 24 of 1997 and PMNA KaBPN No.3 of 1997. The results showed that the implementation of the principle of contradictoire delimitation in the district of Sidoarjo and Pasuruan Land Office was broadly following PP No. 24 of 1997 and PMNA KaBPN No.3 of 1997. However, there are some obstacles to its implementation. This is led by the inconsistency of the land measurements carried out by a third party with the guidelines in technical guide No: 01 / JUKNIS-300/1/2018 attachment 10. There is a need for special quality control related to the work and product results of third parties to improve the quality and minimize the possibility of problems in the future.
