Abstract

Land issues in Indonesia are still characterized by weak legal certainty of land rights, overlapping land ownership, and the widespread practice of land mafia activities through the falsification and manipulation of land documents. The conventional land administration system is considered to have various weaknesses, particularly in terms of data security, transparency, and traceability of land ownership history. As part of land administration reform, the government has implemented the Electronic Certificate policy through the digitalization of land documents to strengthen legal certainty of land rights and prevent land mafia practices. This study aims to analyze the regulation of Electronic Certificates in strengthening legal certainty of land rights, examine their role in preventing land mafia practices, and evaluate the effectiveness of their implementation at the Karanganyar Regency Land Office. This research employs an empirical legal research method with a socio-legal approach. Primary data were obtained through interviews and observations conducted at the Karanganyar Regency Land Office, particularly within the Survey and Mapping Section, the Land Rights Determination and Registration Section, and the Dispute Control and Handling Section. Secondary data were collected through literature studies of laws and regulations, journals, books, and documents related to land administration and Electronic Certificates. The data were analyzed using a descriptive qualitative method. The results of the study indicate that the implementation of Electronic Certificates contributes to strengthening legal certainty of land rights through a digital data storage system that is more secure, transparent, and integrated. Electronic Certificates contribute preventing land mafia practices through the use of certified electronic signatures, land history traceability, and the reduction of opportunities for the falsification of land documents. The implementation at the Karanganyar Regency Land Office has improved the effectiveness of land administration services, although several technical and non-technical challenges remain, including infrastructure readiness, data integration, electronic system security, and public digital literacy. Electronic Certificates have a strategic role in strengthening legal certainty of land rights and preventing land mafia practices through the modernization of a digital-based land administration system. However, their effective implementation still requires strengthening system security, improving the quality of human resources, optimizing land data integration, and increasing public awareness and understanding to ensure the successful achievement of land digitalization objectives.
