Abstract

Land acquisition for public purposes often creates a gap between normative-legal justice and the substantive justice perceived by affected communities. This study examines perceptions of fairness and adequacy of compensation, as well as the socio-economic impacts experienced by entitled parties in the land acquisition for the Bali Cultural Center (PKB) in Gunaksa Village. Using an empirical legal method with a descriptive qualitative approach and a socio-legal perspective, the findings reveal that perceived justice is determined not only by the amount of compensation based on KJPP appraisals, but also by procedural transparency and recognition of non-physical losses, such as emotional attachment to ancestral land. In terms of adequacy, compensation generally meets basic needs and provides opportunities for improved welfare, although the benefits vary according to the socio-economic conditions of recipients. Economically, compensation functions as transitory income that is limited in its ability to replace permanent income sustainably, thereby triggering a shift in livelihoods from the agricultural to the service sector with varying degrees of success. Socially, customary institutions (Banjar Adat) act as a buffer of social capital that minimizes horizontal conflict, although intra-family conflicts over compensation distribution still occur. This study concludes that realizing "fair and adequate" compensation requires a shift from a formal-procedural approach to a substantive approach that considers the post-land-release sustainability of affected communities.
